1. Scope of Application
These General Terms and Conditions (hereinafter referred to as “GTC”) govern the relationship between Cestujeme na Zanzibar a Safari s.r.o. (hereinafter referred to as the “Agency”) and its clients. These GTC apply to all bookings made through the Agency’s website and form an integral part of the contract concluded between the client and the Agency.
2. Nature of the Services
2.1 The Agency acts as an intermediary for local service providers in Tanzania (Zanzibar and mainland), offering services such as excursions, safaris, airport and local transfers, accommodation, and mountain treks (e.g., Mount Kilimanjaro).
2.2 Some services, especially safari packages, are offered as complete products including accommodation and transport, as provided by local partners. These are not individually customizable.
3. Booking and Payment
3.1 Bookings are made directly through the website via an online form and shopping cart system, functioning similarly to an e-shop. The client selects specific services and pays the full price online via secure card payment.
3.2 The contract is concluded upon successful payment and confirmation displayed on the website. No physical contract is sent by email.
4. Prices
4.1 All prices are listed in the booking system and are final at the moment of purchase.
4.2 Prices include all applicable local taxes unless otherwise stated.
4.3 Prices are subject to change based on the offers of local suppliers, but not after the booking is completed.
5. Cancellation and Refund Policy
5.1 The client may cancel the service with a full refund only if the cancellation is made at least 48 hours before the scheduled service.
5.2 For cancellations made less than 48 hours before the start of the service, no refund will be issued unless a medical certificate is provided.
5.3 Refunds (if applicable) will be processed within 14 days via the same payment method.
6. Liability
6.1 The Agency is not the direct provider of the services and shall not be held liable for delays, changes, or deficiencies in the services provided by third parties.
6.2 Clients take part in all activities at their own risk and are responsible for appropriate insurance coverage.
6.3 In case of serious dissatisfaction, the Agency will assist in resolving disputes with local providers but cannot guarantee compensation.
7. Client Responsibilities
7.1 The client is responsible for ensuring their own travel documents (passport, visa) and medical requirements (vaccinations, insurance) are valid.
7.2 The client is obligated to follow local rules, safety guidelines, and the instructions of local providers.
7.3 Any inappropriate behavior may result in exclusion from the service without a refund.
8. Complaints
8.1 Complaints must be submitted to the Agency in writing via email to hello@karibuznz.com no later than 7 days after the end of the service.
8.2 Complaints will be reviewed and answered within 14 working days.
8.3 Complaints submitted after the deadline may not be accepted.
9. Personal Data Protection (GDPR)
9.1 The Agency processes client data in accordance with the EU General Data Protection Regulation (GDPR).
9.2 Personal data is used solely for processing bookings, communication, and internal analysis.
9.3 The Agency uses Google Analytics and similar tools to analyze user behavior on its website. This may include cookies, IP addresses, and browser data.
9.4 By using the website, the client consents to the use of such tools and cookies, in accordance with applicable regulations.
9.5 The client has the right to request data access, correction, or deletion at any time by emailing the Agency.
10. Governing Law and Jurisdiction
10.1 These GTC and all contractual relationships between the client and the Agency are governed by the laws of the Czech Republic.
10.2 Any disputes shall be resolved by the competent court in the Czech Republic.
11. Final Provisions
11.1 These GTC are published on the Agency’s website and are binding for all clients at the time of purchase.
11.2 The Agency reserves the right to update these terms at any time. The current version is always available on the website.
